New details about why Ugandan singer, Desire Luzinda, was not arrested after her nude pictures leaked to the public have emerged. According to our sources, the singer who was at the verge of being arrested for offences of public indecency stipulated under the Anti-Pornography act survived after technicalities set in.
Desire who was being apprehended by police before she showed up at the CIID headquarters in Naguru for interrogation was saved by the constitutional court. According to experts, the current Anti-Pornography law is being challenged by some. For this reason, the constitutional court has been challenged to review and ascertain the constitutionality of the law. The Cabinet of Uganda undertook to review the law since it is against women to a larger extent. Our source tells us that it needs a reform and for this reason the singer cannot be arrested using such a law.
A legal authority that has been fronted to further Desire’s freedom is one of Charles Onyango and Andrew Mwenda Vs Attorney General where it was held that all prosecutions and actions under a law that is being challenged must be put on stand still until the outcome of the challenge is determined. This means that Desire Luzinda cannot be arrested under a law that is being challenged in court.
This has relived the singer of a lot of stress. She has been seen at most happening places in Kampala entertaining revelers who are in love with her Ekitone hit song.
We will keep you posted.
